Bicycle and equipment rental terms and conditions

1st The conditions and regulations for bicycle rental described here aim to define the rules of use and civil responsibilities of customers who enter into bicycle rental and use contracts with Funbike, registered as Suntime Unipessoal Lda, with headquarters at Estrada nac 125 Sitio das Benfarras 510A 8100-065 Boliqueime with number 510091172. The customer assumes and confirms that he has become aware of these conditions and regulations, as well as his responsibility.

2º The bicycles and equipment made available for rent to customers by Funbike are the exclusive property of the company. They are intended for use on leisure trips or sightseeing trips. All equipment is in perfect condition and strictly complies with established safety standards.

Rental conditions and regulations

3º When the customer submits their data on this platform, they declare and assume that they have become aware of these conditions, as well as the rental contract.
The contract will contain Funbike data, customer data, characteristics of the vehicle and equipment, as well as the condition they are in, the rental period and the liability term.

4º The customer is the person responsible for all the equipment included in this contract, as well as for the other people who will use it. It is always necessary to present an identification document when picking up the equipment.

5º In the case of minors, since they have a guardian, the holder of this contract immediately declares to be responsible for the minor(s).

Security deposit

6th Funbike may request a security deposit to collect the bicycle and equipment. Likewise, the customer can leave an identification document with a photo as a deposit in the case of renting one or more days. The security deposit corresponds to the sum of the rented equipment, in accordance with the price list in force. The deposit will be returned at the end of the contract, unless it is necessary to deduct some amount for costs of repairing damages or services not contracted. The customer hereby authorizes the retention of the deposit amount for repair purposes.

7th The customer must return the equipment to the previously defined and agreed location. If returned to a different location, an additional fee will apply. This fee will be €0,65 per kilometer return. Before deciding to return the equipment to another unagreed location, the customer can consult the associated expenses in advance.

8º In case of malfunctions, punctures or damage to the equipment, the repair fees will be applied as indicated in the table below.
Therefore, the Customer authorizes these adjustments to be made on the security deposit, as soon as the adjustment amount or payment via invoice is identified.

9º The security deposit does not cover the total value of the bicycles or equipment rented.
10º In case of theft or theft, the deposit amount will be retained, but it is important to highlight that the contract holder is responsible for paying the full value of the equipment.
Therefore, in situations of theft or theft, the contract holder will be responsible for paying the full value of the equipment. The contract holder is responsible for the rental equipment.

Use of the bicycle

10º The Customer must always use the bicycle prudently, in order to maintain its good conservation, functioning and safety and respect all traffic rules. The Customer must use the security padlock. Although the padlock does not guarantee theft prevention, it is the Customer's responsibility to choose a suitable place to store the bicycle.

11º The Customer cannot transport third parties on the rented bicycle, except in seats suitable for children weighing up to 18 kg. Furthermore, the Customer cannot transfer, sub-rent the bicycle, nor participate in any type of sporting events or similar situations, without authorization .

12º The rental price varies according to the bicycle and time of use. It is important to consult the pricing conditions in the store or online store or simulate the values ​​on this page to obtain updated information.

Equipment Return

13th The customer must deliver the bicycle and equipment included in the rental contract, to the location defined in the contract.
14º If the rented item is not returned within the location and within the period established in this contract, the Holder will be subject to penalties and legal measures.

15 The Owner acknowledges and agrees that failure to return the rented item constitutes a contractual breach and may be treated as theft, subject to legal action and the filing of a criminal complaint.

16th The Customer will be responsible for paying an additional fee, equivalent to the daily rental price of the missing equipment, if the item is not returned to the agreed location and deadline. This additional fee will be calculated based on the length of the return delay and will be specified in the penalty table attached to this contract.

17th Funbike reserves the right to take all legal measures to protect its rights and seek restitution of the property, including, but not limited to, filing a criminal complaint for theft.

18 In addition to the financial penalties mentioned above, the Customer will be held responsible for any legal expenses incurred by Funbike in the process of recovering the rented asset. Therefore, the deposit amount will not be refunded.

19º If the equipment is returned before the end of the contract, there will be no refund or value adjustments.

20º Whenever there is a need for changes to the contract, only increases in value are accepted, such as increasing the number of rental days or changing the return location. These changes must be communicated before the end date of the contract and must be communicated by email or message and duly accepted. In this case, a request for payment of the additional amount that must be paid before the end date of the contract is sent. These arrangements cannot be made through a security deposit.

21º Any change to the conditions of the initial contract, which in the calculation method is a lower value, namely in changing the return location to be different from the contracted one, if this is in the store or another closer location, there is no room for adjustment values .

Customer Responsibilities

22º The Customer is responsible for all damages caused to the rented equipment. In the event of an accident, the Customer agrees to compensate Funbike for the total amount necessary for its recovery or refund, including the costs of workshop materials and labor. The Customer is responsible for compensating any damages caused to third parties.
23º The rental of the bicycle to the Customer does not include any civil liability or personal accident insurance on the part of Funbike. Responsibility for any type of insurance lies exclusively with the Customer. Funbike only has mandatory insurance for tourist activities, and liability coverage depends on the conditions and terms established by the insurance company.
The customer is always responsible until all equipment rented under the contract is returned.
24º The customer is always responsible until the return of all equipment rented in the contract, as well as the location, hotel or accommodation that he leaves for deposit until collection by Funbike. Hotels and accommodation must be easily accessible by car and cannot be located in historic areas that are difficult to access by car. Never under any circumstances should you leave bicycles and equipment on the street, even if they are locked. Failure to comply with these standards may result in payment of the full value of the rented equipment at new value. The deposit amount does not cover the full value of the rented equipment.

25º When the customer does not comply with the rules in leaving the equipment in a closed and safe place, in the custody of a hotel or accommodation or similar, even if the material is recovered, the deposit amount will not be refunded. This happens because the urgency of recovering the material requires us to change our collection logistics, with this as a priority. If Funbike does not recover the material due to theft or theft, the Customer is responsible for paying in full for all equipment at the new value. At this point, Funbike will use legal means to pay the value of the equipment, which is not returned.

Reservations and Cancellation Policy made online bicycle rental on the platform

26ºOnline booking guarantees the availability of the equipment for the scheduled day.
The reservation is always considered to be at least one full day starting at 9 am. It can therefore be picked up at any time from the first hour of booking (9am) and delivered at any time up to 00pm on the same day or the last day of rental.
The reservation is considered when paid and received the confirmation email. Reservations payable in store on the day are not considered reservations.
Reservations are only accepted when 60% of the total amount has been paid. Reservations are always conditioned until you receive the confirmation email that the equipment is available and effectively reserved.
27º Reservations with Funbike partners may have different opening and closing times, but the full day is always considered,

28º We can accept the change of owner, in order to use the reserved equipment. You must communicate the data of the new contract holder by email in the same way and that he or she accepts the rental conditions.

Cancellation policy for online bicycle rental reservations

29º You can cancel or change by email. You must also indicate the order reference.
Within 24 hours of service, there is no right to refund the amount paid.
A discount voucher will be issued within 7 days for use over the next 30 days on services to be rebooked online.
Within 15 days the amount is returned to the payment method. Excluding expenses and commissions, in the amount of 10% of the amount paid.
You can cancel your reservation or postpone it due to weather conditions that prevent safe cycling.

Breakdowns

30º If a breakdown occurs on the rented bicycle in the vicinity of the store, up to 5 km away. Or an anomaly occurs within an hour of using the bicycle and equipment. The Customer must return to the pick-up location to check the anomaly. Or, if necessary, change the equipment. After this trial period, if no problems occur, the equipment will be considered to be in adequate condition for use.

31º If the damage was caused by misuse, the Customer is responsible for the costs related to travel to collect the equipment on site. Plus a value of €25,00 (twenty-five euros) within a radius of 15 km. For longer distances, an additional amount of €0,60 per kilometer will be charged, in addition to equipment repair costs.

Accidents

Funbike is not responsible for any accidents that may occur during the rental period. It is important to note that the Customer is entirely responsible for their own actions and must comply with all rules of the country's highway code when using the equipment.
We recommend that the Customer takes all necessary precautions to ensure their own safety and the safety of others when using the rented bicycles. Although bicycle driving insurance is not mandatory, it is highly advisable that the Customer has insurance. Suitable to cover any personal or material damage that may occur during the rental.
It is the Customer's responsibility to drive prudently and respect all traffic regulations, including the use of a safety helmet when necessary. Funbike cannot be held responsible for accidents caused by negligence, violation of traffic rules or improper use of rented equipment.
When using Funbike services, the Customer agrees to assume full responsibility for any accident, personal injury or material damage that may occur during the rental period.
It is important that the Customer is fully aware of the risks involved in using bicycles and complies with all appropriate safety measures to minimize such risks.
