Bicycle and Equipment Rental Terms and Conditions

1. General Conditions
The following terms and regulations governing bicycle rentals are intended to define the rules of use and the civil responsibilities of clients who enter into rental and usage agreements with Funbike, registered as Suntime Unipessoal Lda, headquartered at Estrada Nac. 125, Sítio das Benfarras 510A, 8100-065 Boliqueime, Portugal, VAT number 510091172.
By entering into a rental agreement, the client acknowledges having read, understood, and accepted these terms and regulations, and assumes full responsibility for their observance.

2. Property and Purpose of Use
All bicycles and equipment made available for rental by Funbike are the exclusive property of the company. They are intended for leisure rides and tourist excursions. All equipment is in perfect working condition and strictly complies with the applicable safety standards.

3. Agreement and Acknowledgment
By submitting their data through this platform, the client declares and acknowledges having read these conditions as well as the rental agreement.
The rental agreement shall include Funbike’s details, the client’s details, the characteristics and condition of the bicycle and equipment, the rental period, and a declaration of liability.

4. Client Responsibility
The client is fully responsible for all equipment covered by this agreement, as well as for any other persons using it. A valid identification document must be presented when collecting the equipment.

5. Minors
In the case of minors, the undersigned of this contract declares to be the legal guardian and accepts full responsibility for the minor(s).

Security Deposit

6. Deposit Requirement
Funbike may request a security deposit upon collection of bicycles and equipment. Alternatively, the client may leave a valid photo ID as a deposit for one or more days’ rental.
The deposit amount corresponds to the total value of the rented items, in accordance with the current price list. The deposit will be refunded at the end of the rental, unless deductions are required to cover damage repair or unpaid services. The client hereby authorizes the retention of part or all of the deposit for repair purposes.

7. Return Location
The client must return the equipment to the agreed location. If returned to a different location, an additional fee will apply. This fee amounts to €0.65 per kilometer (round trip). Clients may inquire about associated costs before deciding to return the equipment elsewhere.

8. Damages and Repairs
In case of breakdowns, punctures, or damage to the equipment, repair fees will be applied as per the table below.
The client authorizes Funbike to deduct the necessary repair costs from the deposit once the amount is determined or upon receipt of an invoice.

9. Deposit Limitation
The deposit does not cover the full value of the bicycle or rented equipment.
10. Theft or Loss
In the event of theft or loss, the deposit will be retained, and the client shall remain liable for the full replacement value of the equipment. The client acknowledges full responsibility for the rented property.

Use of the Bicycle

11. Proper Use
The client must use the bicycle prudently, ensuring its proper maintenance, operation, and safety, and must respect all traffic regulations. The use of the security lock is mandatory. Although the lock does not guarantee prevention of theft, the client is responsible for choosing a secure storage location.

12. Restrictions of Use
The client may not transport third parties on the rented bicycle, except for children in approved child seats up to 18 kg.
Subletting, lending, or participation in sports competitions or similar activities is strictly prohibited without prior written authorization from Funbike.

13. Rental Fees
Rental prices vary depending on the bicycle type and rental duration. Clients are advised to consult the pricing conditions in-store or online, or use the simulator on this website for updated information.

Return of Equipment

14. Return Obligation
The client must return the bicycle and all equipment included in the rental agreement at the specified location and within the agreed timeframe.

15. Late or Missing Return
Failure to return the equipment on time and at the agreed location constitutes a contractual breach and may be treated as theft, subject to legal action and criminal complaint.

16. Late Return Fees
A daily fee equivalent to the rental rate will be charged for each day of delay, in accordance with the penalty schedule attached to this contract.

17. Legal Measures
Funbike reserves the right to take all necessary legal actions to recover the property, including filing a criminal complaint for theft.

18. Legal and Financial Responsibility
In addition to financial penalties, the client will be liable for any legal expenses incurred by Funbike in recovering the rented property. The deposit will not be refunded in such cases.

19. Early Return
If the equipment is returned before the end of the rental period, no refunds or adjustments will be issued.

20. Contract Amendments
Any modification to the contract, such as extending the rental period or changing the return location, must be communicated in advance by email or message and approved by Funbike. An additional payment request will be issued and must be settled before the end date of the contract. These adjustments cannot be deducted from the deposit.

21. Downgrades
Changes resulting in a lower rental fee (e.g., returning the equipment to a closer location) do not entitle the client to any refund or price adjustment.

Client Responsibilities

22. Damages and Liability
The client is responsible for all damages caused to the rented equipment. In case of an accident, the client agrees to indemnify Funbike for the total repair or replacement cost, including materials and labor, and for any third-party damages.
23. Insurance
Bicycle rental does not include personal accident or liability insurance provided by Funbike. The client is solely responsible for obtaining adequate insurance coverage.
Funbike maintains only the mandatory insurance required for tourism-related activities, under the conditions and limits set by its insurer.
24. Storage and Safety
The client remains responsible for all rented equipment until its return.
If the equipment is left at a hotel or accommodation for pickup, it must be in a location with vehicular access and not in restricted or historical areas.
Under no circumstances may bicycles or equipment be left outdoors, even when locked. Failure to comply will result in full payment of the replacement value of the equipment. The deposit does not cover this amount.

25. Improper Storage
If the client fails to store the equipment in a closed, secure location (under hotel or accommodation custody), even if the equipment is later recovered, the deposit will not be refunded.
If the equipment is lost or stolen, the client is responsible for the full replacement cost. Funbike reserves the right to pursue all legal means to recover the owed amount.

Online Reservations and Cancellation Policy

26. Online Reservations
Online reservations guarantee equipment availability for the scheduled date.
Each reservation covers a minimum of one full day, starting at 9:00 a.m. The bicycle may be picked up at any time after that and must be returned by 7:00 p.m. on the same or final rental day.
A reservation is confirmed only after payment and receipt of a confirmation email.
Reservations paid in-store on the day of use are not considered confirmed bookings.
A minimum of 60% of the total rental value is required to confirm a reservation.
27. Partner Locations
Funbike partner stores may have different opening hours; however, the rental is still considered a full-day rental.

28. Change of Holder
A change in the person responsible for the rental may be accepted upon written request via email, including the new client’s details and acceptance of these terms.

Online Cancellation Policy

29. Cancellations and Changes
Cancellations or changes must be requested by email, indicating the order reference.
Within 24 hours of the rental: No refund.
Within 7 days: A voucher will be issued, valid for 30 days toward a new online reservation.
Within 15 days: A refund will be issued using the original payment method, minus 10% for administrative and processing fees.
Cancellations due to adverse weather conditions preventing safe cycling are accepted without penalty

Breakdowns

30. Equipment Issues
If a malfunction occurs within 5 km of the shop or within one hour of use, the client must return to the shop for inspection or exchange. After this initial period, the equipment will be considered in proper working condition.

31. Damage Due to Misuse
If a malfunction results from misuse, the client shall bear the transport and repair costs.
A €25 service fee applies within a 15 km radius; beyond this distance, an additional €0.60 per kilometer will be charged.

Accidents

Funbike is not responsible for any accidents occurring during the rental period. The client is entirely responsible for their own conduct and must comply with all applicable traffic laws.
The client is strongly advised to obtain personal accident and liability insurance covering potential injury or property damage during the rental period.
The client must ride responsibly and observe all road safety regulations, including the use of helmets when appropriate.
Funbike cannot be held liable for accidents resulting from negligence, traffic violations, or improper use of the rented equipment.
By using Funbike’s services, the client agrees to assume full responsibility for any accidents, personal injuries, or property damages occurring during the rental period.

Omissions and Governing Law

For any matters not covered by these terms and regulations, the parties shall refer to the applicable laws in force in Portugal.
